NASSCOM recently submitted response on the proposed amendments to the Consumer Protection (e-Commerce) Rules, 2020 (e-Commerce Rules) to Department of Consumer Affairs. A summary of the proposed amendments can be found here

In our submission, we undertook a clause-by-clause review of the proposed amendments along with suggested approach, wherever needed. We also suggested changes to the text of the e-Commerce Rules, notified on July 23, 2020, based on some of the proposed amendments, in track-mode for ease of reference. Overall, our submission focussed on:

  • Emphasising the centrality of consumer protection while regulating e-commerce under the Consumer Protection Act, 2019.
  • Imposing obligations while keeping in view the uniqueness of different e-commerce models.
  • Rationalising obligations in line with activities undertaken by the relevant entity in the e-commerce supply chain.
  • Ensuring maximum protection to the consumer in case unfair trade practices are undertaken that harm the consumer.
