In my last blog “Indian Deep tech start-ups focusing on Innovation ”, we discussed about the key patent filing trends across deep-tech start-ups in India.

In the last few blogs I have been discussing the key patent filing trends in India, now let’s discuss about the process of patent filing in India.

Over the last few years, the patent filing process in India has become more streamlined and grants have been faster compared to historical standards, driven by vatious initiatives by the patent office.

However, challenges in terms of timelines and lack of examiners persists compared to global counterparts.

  • Compared to 2018 the efficiency of patent filing and pendency at the patent office has improved, however final decision on a patent in India remains slow compared to global patent offices highlighting insufficient machinery at the patent office.

  • Lack of sufficient patent examiners, lack of experience also remains a key challenge.

These challenges can be managed through collaborative efforts across stakeholders in the patent ecosystem including government, patent office, industry, start-ups, academia as well as patent filers. Some of the key recommendations that from the report includes:

  • Improving the patent filing portal and number of examiners with relevant domain knowledge
  • Emphasis on quality of patents and not quantity
  • Create a unified DeepTech IP discovery tool
  • Build a culture of innovation through stakeholder collaborations
