IP Creation Continues to Reach New Highs in the New Normal

According to World Intellectual Property Indicators (WIPI) 2022 report, worldwide IP filings reached an all-time high, with 3.4 million patent applications, 13.9 million trademark applications (specifying 18.1 million classes), and applications for 1.5 million designs filed in 2021. This is in line with the fact that 2021 has been a year of consistent recovery across the globe.

Global patent applications returned to pre-Covid-19 levels in 2021

Worldwide patent applications reached 3.4 million in 2021, slightly higher than the pre-COVID peak of 3.3 million filed in 2018, and registered a growth of 3.6% in 2021 compared to 2020. This growth followed an increase of 1.5% in 2020 after a 3% drop in 2019.

Asia continues to Lead Patent Filing in 2021

Led by China, Asia accounted for two-thirds of the patent filing in 2021, up from a little over 50% in 2011.

China the Global Patent Filer Leader

China led patent filing with 1.59 million applications in 2021, more than double the second holding of the USA with 591,473 patents; which was followed by followed by the Japan Patent Office (JPO) (289,200), the Korean Intellectual Property Office (KIPO) (237,998) and the European Patent Office (EPO) (188,778). India is in the sixth position and received the majority (57.3%) of its applications from non-residents. Other top jurisdictions which received the majority of their applications from non-residents include - Australia (90.8%), Canada (87.3%), the EPO (55.6%), and the USA (55.7%).

The Shift of Global Patent Leadership from US to Japan to China

Till 1963 US was the leading office for world filings, application numbers in Japan and the US remained stable until the early 1970s, at which time Japan began to experience rapid growth – a pattern also observed for the US from the 1980s onward. Japan surpassed the US in 1968 and retained top position until 2005.

Since the early 2000s, however, the number of applications filed in Japan followed a downward trend. China surpassed the EPO and the Republic of Korea in 2005, Japan in 2010 and the US in 2011, and now receives the most applications worldwide.

Overall, the top 5 offices there has been a gradual upward trend in the combined share of the top five offices in the world total – from 78.5% in 2011 to 85.1% in 2021.

Overall, patent filing remains an important focus for the top offices, with India trying to catch up, however there remains a large ground that needs to be covered.
