NASSCOM Submission on Draft Delhi Motor Vehicle Aggregators Scheme 2022

In August 2022, NASSCOM submitted feedback and suggestions on the draft Delhi Motor Vehicle Aggregator Scheme 2022 (the Scheme) published by the Transport Department, Government of National Capital Terriroty (NCT) of Delhi. The Scheme seeks to regulate aggregators providing passenger transport services, and other delivery aggregators providing delivery service of goods and commodities, including last-mile delivery service providers.

Our submission highlighted concerns of the industry and offered the follwoing suggestions:

  1. The targets for onboarding Electric Vehicles (EVs) by aggregators should be revisited in light of the state of the ecosystem, availability of EVs and availability of supporting infrastructure in NCT of Delhi.
  2. The electrification mandates for 2 wheelers and 3 wheelers must be assessed according to the availability of commercial electric 2-wheelers and 3-wheelers.
  3. Mandates for onboarding electric 3-wheelers should be revisited in light of the permit caps in NCT of Delhi.
  4. Licencing fee amount and structure should be revised and based on the Motor Vehicles Aggregator Guidelines 2020 notified by the Ministry of Road Transport & Highways.
  5. The Scheme should not prescribe age of vehicles to be used in the fleet. In any case, it should adhere to the scrapping policy and orders of the National Green Tribunal that allow cars of up to 15 years of age (diesel) and 10 years of age (petrol) to be used in Delhi.
  6. The requirement for physically fitting a vehicle tracking and monitoring device in the vehicle should be relaxed. Fitment of a digitally enabled Vehicle Tracking and Monitoring System with panic buttons, should be acceptable for tracking and monitoring of vehicles under the Scheme.
  7. Aggregators should, at the most, be mandated to distribute branding elements to the drivers, but not be made responsible for exsuring if the drivers are using the branding elements on the vehicle. 
  8. In view of consumer safety and effective grievance redressal, all types of grievance redressal systems with a 24*7 call assistance feature that is effective and achieves the intended result, without the rigid requirement of setting up a call centre, specifically.
  9. To help aggregators in ease of doing business, the Government should notify a simple and online process for submitting the required quarterly reports. Such reports should be accepted via e-mail, or an end-to-end digitised online portal should be put in place.
