Seeking Inputs: Draft Haryana Maternity (Amendment) Rules. 2019

Haryana Government has recently published Draft Haryana Maternity (Amendment) Rules, 2019 , for setting up Creche facilities.  The rules are applicable to establishment with 50 or more employees in the State.

Following are some of the key provisions of the draft Rules:

  • The rules mandates establishments to setup Creche facility within a vicinity of workplace or within a walkable distance of 500 meter from the gate of the establishment
  • The Draft rules mandates four visits to the Creche of 20 minutes each to the women employees
  • The rules prescribes Creche to remain open both during day and night as per the timings of the employees
  • The rules mandates recruitment of adequate staff for attending the needs of the children such as female attendant, cook, sweeper, chokidar etc.
  • The rules prescribe monthly medical checkup for kids and once in two months for nursing mother by qualified medical practitioner
  • It further mandates maintenance of records of children attending a crèche and register for complaints by the employer
  • The rule also mandates certain conditions regarding the building material that is to be used for creating such facilities e.g. walls and roofs of such facilities should be heat resistant and water proof.
