Revised Notification on Women Employees in Night Shifts in the State of Haryana

On February 21, 2023, the Department of Labour, Haryana Government issued a revised notification on the employment of women employees in Night Shifts.  

Earlier, on June 07, 2022, the Government of Haryana issued a notification exempting employment of women employees in night shifts.  

While the IT/ITeS sector is deeply committed towards the safety of women employees and adopts necessary measures to this effect, the notification imposed certain conditions which posed operational challenges and could have been counter-productive for women employees.  

Over the past few months, NASSCOM extensively engaged with industry and the Government of Haryana to address industry concerns with respect to ease of doing business and ensure due safety and security of women employees.  

We have summarised below the important changes introduced through this revised notification.  

  • Night shift commencement time has been changed to 8pm, earlier it was 7pm.    
  • The revised notification now only uses the term ‘employee’ instead of ‘workers and employees’.  

Clause wise changes:

Clause 2: Exemption is valid for 1 year unless there is change of security, transportation agreements and other details of occupier/director/manager.  

Clause 11: The employer must submit a declaration to the Labour Commissioner that consent of women employee has been obtained. Although it is not specifically mentioned, submission through e-mail may suffice. Earlier, there was a need for sending a copy of declaration/consent Form to the Labour Commissioner, which has been removed.  

Clause 15: No separate canteen facility for women employees in the IT/ITeS sector.  

Clause 16: CCTV cameras to be installed only in buses. No female security guards are required in transportation vehicles.  

Clause 17: Earlier, there was a requirement of minimum batch of 10 women employees & minimum number of women employees in a night shift should have been equivalent to 2/3rd of total strength. Similarly, for female supervisory staff, there was a minimum requirement of 1/3rd supervisory staff of the total strength. 

This condition has been removed.  

However, the notification prescribes minimum women staff should be 1/3rd of total strength in logistics and warehouses. Further, the calculation of 1/3rd will include supervisor, shift in charge, and employees. Earlier, this was calculated separately for employees and supervisory staff. 

Clause 18: For establishments with a strength of more than 100 women employees, there was a need to keep a separate vehicle to meet medical emergencies. Now tie-ups have been allowed for provision of such vehicle.  

Clause 24: Annual report is to be sent to the Labour Commissioner. Earlier, this requirement was half-yearly.
