On April 26, 2023, nasscom organised a roundtable discussion with the industry to gather feedback on the industry’s experience with one of India’s bulk licencing policies – the GAICT policy. GAICT policy as first introduced in July 2019, and thereafter revised in June 2022, taking into account industry’s feedback.

The roundtable focussed on gathering industry’s feedback on the procedure as well as the scope of the existing GAICT policy.

Key-takeaways from the discussion:

  1. List of exclusions in Annexure 1 of GAICT: Industry expressed that one of the limitations is that certain items under SCOMET Category 8 that are of high-export interest to the industry are currently excluded from the scope of GAICT. Therefore, there is interest among the industry to seek inclusion of certain items under GAICT.

  2. Turnaround time of GAICT applications: Industry expressed concerns with the turnaround time of GAICT applications and shared suggestions on how the process can be expedited.

  3. Responses by DGFT to industry’s queries: Industry expressed concerns regarding the delays faced in receiving adequate and prompt responses from DGFT to industry’s queries.

  4. Post-shipment reporting: Industry shared the different practices being followed for the purposes of reporting ‘value of intangible exports’ under SCOMET or GAICT applications or post-shipment reporting requirements. For example, declaring the value as USD 1, declaring the value mentioned in the purchase order, declaring a value along with an explanation that it is difficult to arrive at a value in case of technology and software etc.

We continue to engage with the industry and the Government with a view to enhance and improve India’s export control regime.
