India Patent Filing System – More Needs To Be Done

In my last blog I discussed about the key hits and misses of the Indian patent filing system. Now since we have highlighted the issues we need to work towards solving for it. So when we spoke to our stakeholders on the problems that they face with respect to patent filing, we also asked them to give us the solutions in terms of the best practices that they are following to make patent filing a success story for their organisation. We also asked them suggestion for other stakeholders including the patent office, to make patent filing in India a better experience.

In this blog we would focus are discussion on the key recommendations that were given by the various stakeholders.

Patent Filing System in India – Best Practices

For the report we spoke to some of the leading organisations as well as academic institutes who are focused on IP creation to understand the common initiatives that they have undertaken to make a successful culture of innovation at their end.

While talking to organisations some of the common practices that were highlighted included creating awareness on IP creation, rewarding innovation through multiple ways, facilitating patent filing for the deserving innovation after strong due diligence and strong leadership support which also included setting up of separate R&D units and COEs. The key highlight that came from the discussion is that patent filing is an investment and thus its very important to have a through due diligence before a patent is filed. While doing that its very important to make sure that the innovation is either solving a societal problem or makes a business problem – as this is the key fulfilment criteria for an innovation before it can be taken forward on the IP creation route.

The same points hold true on the academic side as well where they are also focused on creating awareness, Separate IP cell and due diligence. The additional factors that become important for the academic institutions are industry collaboration both on co innovation as well as partnership for licensing the innovation and taking it to market.

Patent Filing System in India – Recommendations

In order to bridge the gap we see between India and other leading global patent offices all stakeholders need to work together to solve for the key issues highlighted in my last blog. Some of the key recommendations have been summarised below:
