On July 29, 2025, The Controller General for Patents, Designs and Trade Marks (CGPDTM) released the Guidelines for Examination of Computer Related Inventions (CRIs), [CRI Guidelines]. As per the press release, the guidelines aim to enhance clarity, consistency, and predictability in the examination of CRIs, particularly in response to the rapidly evolving technological landscape.

The examination of inventions relating to AI, blockchain, and quantum computing is covered under a separate chapter (Chapter 5). Importantly, the CRI Guidelines provides numerous non-exhaustive illustrative scenarios to discuss the patentability of inventions. We had highlighted the need for providing reasoning behind patentability/non-patentability of claims in the cited examples in our feedback on the first version of the CRI Guidelines.

The guidelines also provide a non-exhaustive list of examples (total: 60) in Annexure I to illustrate allowable/non-allowable inventions under four limbs of section 3(k), i.e., mathematical method, business method, algorithm, and computer programme per se.

Finally, given the focus on emerging technologies like AI, blockchain, and quantum computing, regular engagement with stakeholders on patent-related aspects of these technologies would be important for making any potential revisions.
