In my last blog “GROWING PROMINENCE OF GLOBAL IP CREATION”, we talked about the global patent filing trends from the nasscom patent report.

In this blog let’s look at the India patent filing story that has seen tremendous progress over the last year. In FY23 India witnessed patent filing of 83K applications, registering a growth of 24.6% y-o-y, highest over the last two decades. Moreover, this growth is expected to continue as the Indian patent office has recently announced highest annual patent applications filing of over 90K in CY23.

The story is similar on the grant side which has witnessed a significant growth since FY19. Some recent numbers released by the patent office indicate a substantial focus on granting patents with the patent office granting over 100k patent between 15th March 2023 to 14th March 2024.

Resident Filers in India crossed the 50% mark for the first tome in FY23

Over the years, the patent filing in India had been dominated by MNCs in the country, with India resident companies, institutions and individuals taking a back seat. This trend has been on a reverse path over the last couple of years with the share of resident patent filing increasing 2X in the last decade, accounting for over half of the patent filed in FY23 – indicating growing IP awareness and innovation focus.

In terms of entities educational institutions have led the growth in patent filing accounting for 23% of all the applications filed in FY23 and increase from 11% in FY22. Though, this is a good trend, on the hindsight the challenge is a significant increase in bogus filing from certain institutions, which are just filing for their NIRC ranking. We will talk more on this when we deep dive into the recommendations from the report.

In terms of State Tamil Nadu led Patent Filing, while USA led the PCT applications filed in the country.

Tamil Nadu took the top spot with a share of 9.3% in total patent filing during FY23, surpassing Maharashtra (6.8%), which has been the leading state till FY21. Key drivers that supported this growth  includes conducive policies, strong R&D system, Increasing number of PHD scholars, Educational Institutions like IIT Madras focusing on IP creation, and a focus on IP awareness and innovation culture.

PCT applications filed in India by major countries increased to 32K in FY23 from ~30K in FY22, with US being the top filer with a share of 37.9%. The increasing number of PCT applications are also reflective of the fact that India is establishing itself as a key market for countries across the globe.
