On July 6th, 2022, NASSCOM made a submission to the Ministry of Electronics and Information Technology (MEITY) in response to the call for inputs on the Proposed Amendments to the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 (IT Rules 2021). The proposed amendments are available here and our blogpost summarizing them are available here.

In our submission, we noted the need for reforms of India’s intermediary liability regime to focus on two key outcomes: (1) Calibrated and proportionate due diligence obligations on intermediaries by differentiating between them based on their role, services, size, and impact in the market (2) Policy certainty, clarity in expected compliances and a risk-based framework.

Further, we noted the need for greater clarity on the formulation of the Proposed Amendments, especially to reflect the clarifications offered by MEITY during a recent public consultation on the Proposed Amendments. We also reiterated, from past submissions on the IT Rules 2021, the requirement for MEITY to release Standard Operating Procedures on various aspects of the IT Rules 2021.
