On March 7, 2024, nasscom submitted feedback on the draft General Authorisation for Export of Information Security (GAEIS) policy. The draft policy was released for consultation on March 1, 2024, summary can be accessed here.

Our key suggestions to further streamline the policy are as follows:

  1. Clarification on Post-Shipment Procedures: The current draft of the GAEIS policy needs refinement regarding post-shipment obligations. Specifically, Paragraph V should be amended to accurately reflect that reporting requirements are to be fulfilled after export, not before. This adjustment would provide clear guidance to exporters and ensure consistency in compliance procedures.

  2. Applicability to Re-Exports: There is ambiguity regarding the applicability of the GAEIS policy to non-indigenous items, for example re-exports of those involving items of partial indigenous origin. Clear guidelines are needed to address scenarios where imported items are re-exported from India, ensuring exporters understand their eligibility under the policy.

  3. Exclusion of Items from Annexure 1: Regarding Annexure 1, it may be beneficial to reevaluate the inclusion of items that fall outside the scope of Category 8A5 Part 2. Streamlining Annexure 1 by removing such items could simplify the application process for the GAEIS policy.
