As you might be aware, the NPD Committee released its draft report for public comment earlier in July, 2020.

In its draft Report, the NPD Committee sets forth a regulatory framework for the processing and sharing of non-personal data in India with a view to generating economic benefits for citizens and communities in India, creating incentives for data driven innovation, and leveraging non-personal data towards greater social, public and economic value.

To this end, the NPD Committee recognizes various stakeholders in the ecosystem, and recommends the operationalisation of a non-personal data sharing framework and the establishment of a Non-Personal Data Authority (NPDA). It also places obligations upon significant collectors and processors of non-personal data to share meta-data with the NPDA, and ensuring processing in a manner consistent with the best interests of the data principals or communities, to whom the non-personal data relates. Likewise, it recommends safeguards against re-identification of anonymised personal data, and any consequent harms to privacy. Lastly, it puts in place various voluntary and mandatory non-personal data sharing mechanisms, with varying conditions of sharing – which may involve either no compensation (such as in the case of raw data) or compensation through license fees determined in a fair, reasonable and non-discriminatory manner.

The Report, presents the industry with many firsts, and is one of the first Government led efforts across the world to define a strategic and regulatory framework to leverage non-personal data to the social and economic benefit of the country, and recognize concepts such as “community data”.

Given the significance of the recommendations, NASSCOM and DSCI conducted an interactive session with the members of the NPD Committee earlier on 11 July, 2020, before kick-starting an industry consultation and calling for feedback on the NPD Committee’s recommendations.

As NASSCOM works to finalize the industry’s formal submission to the NPD Committee, NASSCOM together with DSCI, is conducting a series of Online Policy Roundtables to discuss the industry’s feedback on the report.
