In my last blog I discussed about the key Indian patent filing trends. Taking that discussion forward lets now talk about the good initiatives and the challenges in the Indian patent filing trends in India.

Patent Filing System in India - The Hits

In the last blog we discussed that the Indian patent office has seen continuous increase in the patent filing over the last few years. This growth is driven by the various initiatives taken by the Indian patent office including modernisation and improvement of the whole process, new initiatives to fast track the process and many more, as highlighted below:

Patent Filing System in India - The Misses

However, there is still a lot of ground that needs to be covered when we compare India Patent Office to other global counterparts. The data on some of the leading global patent offices clearly reflects a huge gap that needs to be bridged on number of resident patent applications, time taken to finalise a patent application, as well as the expertise available at the patent office.

The Major Challenges

Though the data highlighted some of the issues, the report went ahead and spoke with the key stakeholders to understand the major challenges that they are facing and what we got was supporting arguments to the WIPO data plus a few other concerns like - some of the legal clauses that are specific to India, and cost attached to filing a patent as the process remains very complex and organisations need to take legal help. Some of the major issues have been summarised below:
