The Directorate General of Foreign Trade (DGFT) issued a public notice to amend provisions in the Handbook of Procedures (HBP) 2023 regarding the General Authorization for Export after Repair (GAER). The amendments simplify the process, allowing Indian companies to re-export imported Special Chemicals, Organisms, Materials, Equipment, and Technologies (SCOMET) items after repair under a single, one-time authorization rather than seeking approval for every shipment. These exports must be directed only to related entities or authorized supply chain vendors overseas, subject to specific conditions and mandatory quarterly reporting.

Key Highlights:

  • One-time General Authorization: Exporters can now secure a single authorization valid for one year for re-exporting repaired SCOMET items to related entities or authorized vendors.
  • Eligibility Conditions:
    • Items imported for repair must not undergo any specification change or value addition.
    • Export allowed exclusively to related entities (parent/subsidiary companies) or authorized repair vendors.
    • No export allowed to sanctioned or high-risk destinations as identified by UNSC or IMWG.
  • Mandatory Compliance:
    • Companies must have an Internal Compliance Programme (ICP) certification, mandatory for intra-company transfers.
    • Authorized Economic Operator (AEO) certification along with ICP compliance is required for exports to external vendors/OEMs.
  • Documentation and Reporting:
    • Submission of Bills of Entry and contractual agreements are mandatory.
    • Quarterly post-shipment reporting to DGFT is mandatory.
    • Non-compliance may lead to penalties, suspension, or revocation of authorization.
  • Restrictions:
    • GAER not applicable if items could be used for developing weapons of mass destruction.
    • No export allowed when the initial export authorization has been revoked by the importing country.
