Export control laws are applicable to the tech-industry in India, and need to be complied with by companies who export controlled goods, software and technologies out of India. This is especially relevant for companies exporting software/technology in aerospace, drones, cybersecurity, defence, telecom sectors. These compliances become tricky because exports of technology/software occur in an intangible form. Given the technological advancements and the complexity of supply chains today, effective export controls depend largely on the awareness of companies and their active efforts to comply with export control obligations. For this, organisations establish a set of internal policies and procedures, also known as an Internal Compliance Programme (ICP).

In furtherance of NASSCOM’s efforts in supporting the industry in export control compliances, enhancing awareness and creating a dialogue between the industry and the government, we are organising a webinar on the topic of ICPs For Export/Transfer of Dual-Use Items. The discussions in this webinar will include talks by senior officials of Directorate General of Foreign Trade, Ministry of External Affairs, Ministry of Electronics and IT on the significance of ICPs in managing export control obligations, and presentation from industry representatives on best practices in implementing ICPs in their organisations.

We will also launch a booklet titled ‘Elements of an Effective Internal Compliance Programme For Export/Transfer of Dual-Use Items’. The elements covered in the booklet provide a framework for organisations to identify and minimise risks associated with export/transfer of dual-use items, and to ensure compliance with the relevant national laws and regulations. This booklet also provides a checklist that can be submitted by exporting organisations when applying for a general authorisation to the licensing authorities in India. The webinar and the booklet is relevant for IT companies exporting controlled technology/software, where most exports take place through an intangible medium.
