NAASCOM feedback on Designing the Future of Dispute Resolution: The ODR Policy Plan for India, released by NITI Aayog

In October 2020, NITI Aayog released a draft discussion paper titled ‘Designing the Future of Dispute Resolution: The ODR Policy Plan for India’ (ODR Paper). The ODR paper makes several recommendations for better implementation and scaling up of ODR in India. A brief overview of the paper can be read here.

On 11 November 2020, NASSCOM submitted feedback on the draft discussion paper on ODR policy plan for India. The key points made in our submission are listed below.

  1. In addition to the plan of scaling up existing ODR systems, there is a need to address the shortcomings of the existing ODR systems and use the learnings to build a more robust ODR regime in India.
  2. There is a need for undertaking a mapping exercise to identify sectors for prioritising onboarding of ODR, such as, consumer grievances, e-transactions disputes, family matters (divorce and maintenance), debt and money due cases, small value claims etc. This exercise will help in identification of sectors that are more likely to embrace and be benefitted from ODR and incorporate ODR provisions for dispute resolution in those sectors.
  3. To unlock the full potential of ODR in India, there is a need to develop a clear action plan for the implementation of three aspects of onboarding technology in dispute resolution, i.e., transforming processes online, creation of alternative modes of pre-court dispute resolution, and reducing disputes.
