Update: Haryana Government approves Haryana Data Centre Policy, 2022

Based on news reports, the Haryana government has recently approved the Haryana Data Centre Policy (Policy). This is to make Haryana a preferred destination for setting up such facilities, and help the state emerge as a global data centre hub. Some of the features of the Policy as provided in the news report(s) are as follows:

  • Data centre spaces will be declared as a separate infrastructure industry as well as energy-intensive industry.
  • Data centres may also be declared as an essential service under Haryana Essential Services Maintenance Act, 1974.
  • Any data centre set up in Haryana with 1 MW and above power consumption will be eligible for various benefits under the new policy.
  • Benefits under the policy include 50% net SGST reimbursement for a period of 10 years in 'A' & 'B' category blocks, 75% net SGST reimbursement for a period of 10 years in 'C' and 'D' category blocks, 100% reimbursement of stamp duty paid on sale/lease deeds to establish a data centre and 100% exemption from electricity duty for 20 years.

In this regard, NASSCOM had made a representation to Haryana Government in July 2021. We had highlighted the following suggestions for inclusion in the Draft policy:

  1. Land – Provide for an option that enables purchase of land by the Data Centres. Further, suitable location around Gurgaon and Faridabad may be identified for setting up data centres.
  2. Regulatory Clearance - Enable a deemed approval system for statutory / regulatory clearances.
  3. Power - Allow Data Centres to procure and use renewable energy to meet 100% of their power needs.
  4. Building Norms – Consider certain requirements for inclusion in revised building codes for data centre, such as G+4 structure to house Diesel Gensets, Up to 6.5m slab to slab height without any implication on the FSI, Chiller platform on terrace, up to 3.5m height, to store chillers, etc.
  5. Definition of Data centre park – Amend the eligibility criteria for availing incentives under the policy to include any Data Centre Park with an installed power capacity of 1.5 MW, irrespective of the area occupied.
