The Ministry of Electronics and Information Technology (“MeitY”) has released draft amendments to the Aadhaar Authentication for Good Governance (Social Welfare, Innovation, Knowledge) Rules, 2020 (“Rules”) enabling Aadhaar authentication by entities other than Government Ministries and Departments.

As per the current Rules only Government Ministries and Departments can undertake Aadhaar authentication for the purpose of good governance, preventing public fund leakage, and promoting innovation and knowledge.

The draft amendments propose 2 changes:

First, adding “promoting ease of living of residents and enabling better access to services for them” to the above list of purposes.

Second, establishing an enabling framework for entities other than Government Ministries and Departments to undertake Aadhaar authentication – however, only after they submit a proposal to a Central/State government department, justifying that the use of authentication for one of the above purpose and is in the interest of the State. If that department agrees with the proposal, it will send it to MEITY with recommendations for consideration to the UIDAI.

If the UIDAI approves the proposal, it may approve the entity to start undertaking Aadhaar authentication in accordance with the Act and the proposal, and for the relevant government department to notify the same.
