On March 27, 2024, DGFT released the bulk licensing policy - General Authorisation for Export of Information Security (GAEIS) and Telecommunication (GAET). 

The DGFT had previously published a draft policy seeking public comments. The final policy addresses many concerns and provides a robust framework for exporting information security and telecommunication-related items while maintaining necessary safeguards. Further, the GAIES policy incorporates recommendations proposed by nasscom.

Key changes in the final policy include:

Clarification on re-exports: The final policy provides clarity on the application of the bulk licensing policy concerning the re-export of items, as was sought by nasscom in our feedback. Additional post-shipment requirements for re-exports have been introduced to ensure compliance, including documentation proof of matching items imported for re-export, details of items in the bill of entry, and confirmation of export regulations in the country of re-export.

Exclusion of Annexure 1: Annexure 1, which listed exceptions to the licensing application, has been removed, as was also suggested by nasscom. This streamlines the licensing process and provides clearer guidelines for exporters.

Clarified Scope: The scope of the policy has been clarified to include Category 8A5 Part 1, excluding 'technology.' 

The rest of the conditions and relaxations in the policy remain consistent with the draft version as summarised here.
