Seeking Inputs: Draft Labour Code on Social Security and Welfare 2018

Pursuant to the preliminary draft on social security code 2017 which was published by Government last year, the labour ministry has now published revised labour code on social security and welfare 2018 seeking inputs from the stakeholders through employer’s /workers associations.

The said code is in line with the Government objective to simplify, rationalize and consolidate all existing labour laws relating to Social Security (total 15 labour laws including EPF Act, ESI Act, Maternity Benefits Act, Payment of Gratuity Act etc),  to make them less complex for easier comprehension implementation and enforcement. The code has envisaged an all-encompassing social security regime based on principles such as:

  • Universalization to entire workforce
  • Integration of fragmented schemes
  • Decentralization of administration
  • A rights based approach
  • Single Window Compliance
