On January 2, 2023, the Ministry of Electronics and Information Technology (MEITY) released draft amendments to the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 (IT Rules), related to online gaming. 

Key additions include:   

  • Definition of 'online game' and 'online gaming intermediary'
  • Extending the due diligence requirements under rule 3(1) to online gaming intermediaries
  • Additional due diligence requirements to be observed by online gaming intermediaries, such as, appointment of chief compliacne officer and nodal contact person, having a physical contact address in India,  facility to users to voluntarily verify their accounts, publication of no-bot certificate etc.
  • Registration of online games with a self-regualtory body based on specified criteria. 
  • Establishment of a framework by self-regulatory body for the protection of specified interests, testing and verification protocols.  
  • Safeguards in relation directions issued under section 69A of the IT Act, such as, reference to the report submitted by a self-regulatory body on the basis of registration of an online game.
  • Establishing a grivance mechanism for resolution of complaints of users that have not been resolved by the grievance redressal mechanism of the online gaming intermediary.
  • The Government can notify any game available on the internet to be treated as an 'online game' under these rules, if it is satisfied that the game creates a risk of harm to sovereignty and integrity of India or security of the State or friendly relations with foreign States or public order, on account of causing addiction or other harm among children.
