On November 21, 2023, the Delhi Motor Vehicle Aggregator and Delivery Service Provider Scheme, 2023 (the Scheme) was notified by the Government of National Capital Territory of Delhi (GNCTD). The scheme is for licensing and regulation of aggregator providing passenger transport services and delivery service provider providing delivery service of goods.

Electrification Targets: Among other things, the policy mandates all passenger vehicle aggregators and delivery service providers to switch their fleet entirely to electric by 2030. A phased electrification target for newly onboarded fleet has been provided, wherein, all new fleet should be EVs within 5 years from the date of notification of the Scheme. As per nasscom’s feedback, the Scheme has partly relaxed the electrification target, i.e., for 2-wheeler passenger vehicles.

Other obligations include:

  1. Licence: All aggregators of passenger services (aggregator) and delivery service providers operating in the NCT of Delhi must obtain a license within 90 days from the date of notification of the Scheme. Licence will be valid for 5 years.
  2. Declaration of vehicular fleet: All aggregators and delivery service providers must declare all on-boarded vehicles in use. Details should include registration certificate, vehicle category, maximum passenger capacity/load bearing capacity, fuel type etc.
  3. Compliances for Aggregators:
    1. Provide an operation centre that can track movement of all onboarded vehicles and drivers in real-time.
    2. Ensure that the driver has the following at the time of onboarding - a valid driving licence, a valid registration certificate and a valid public service vehicle badge (if applicable).
    3. Ensure that all vehicles (3-W and 4-W) on-boarded at the time of registration bear commercial registrations.
    4. Aggregator to be liable for all the services provided to the end-user, except in case of vehicle accident, where the primary responsibility will be of the Driver.
    5. Ensure that the vehicles are kept in a clean and sanitary condition at all times.
    6. Must include a feature enabling the rider to share the live location and status of the ride after the commencement of ride.
    7. Ensure transparency in its operations, such as functioning of the App algorithm, proportion of fare payable to the driver, incentives given to the drivers, charges received from the driver etc.
    8. Aggregator's Website and App and updating such disclosures, as perrequirement.
    9. Safety related compliances, such as, properly functioning GPS, monitoring of route, spot-checks of vehicles, fire extinguisher (for 4-W), disabled child lock mechanism (for 4-W), enabled manual override for the central locking system (for 4-W) etc.
  4. Compliances for delivery service providers:
    1. Ensure that all vehicles (3-W and 4-W) on-boarded at the time of registration bear commercial registrations and vehicles comply with the Motor Vehicle Act.
    2. Ensure compliance with motor vehicle load limits prescribed by the Ministry of Road Transport and Highways.
    3. Ensure that the driver has the following at the time of onboarding a valid driving licence and a valid registration certificate.
